The Wedding Report, Inc. Terms of Service
This is a legal agreement between you (a single end user) and The Wedding Report, Inc ("us," "we," or "the Company").
Read this agreement carefully. Your access to The Wedding Report, Inc. all data on www.theweddingreport.com, and any information provided through email or phone conversation (collectively, "the product") is subject to the terms, limitations, and exclusions below.
Product
The Company offers a distinct Product:
- "Data" - This includes all data and information contained on www.theweddingreport.com, provided through email or phone conversation, including statistics, research, and any other data.
Licensed, Not Sold
The product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The product is licensed, not sold.
By subscribing to The Wedding Report, Inc. you only obtain a license to use the product, subject to the rest of this agreement. When your license expires or is terminated, you lose any and all rights to use or access the product.
Single User
Only individual people may obtain a license to the product, and such license may only be used for that person. Licenses cannot be shared. Companies and organizations must purchase a separate license for each person who needs to access the product.
Data Use License
You may use data or information from the Product for personal use, for internal business use, business and marketing plans, and business and marketing plan presentations.
NO OTHER USE
You may not use data or information from the Product for any other purpose "except those mentioned in the Data Use License," without written permission from The Wedding Report, Inc.
Termination
You can terminate your License(s) with us at any time. Termination at your direction will take effect at the end of the current billing cycling, and you will not receive a refund of any monies paid to the Company.
You agree that we can terminate your License(s) if you violate this agreement in any way. Termination due to violations of these Terms of Service will take effect immediately.
Disclaimer
The Product is provided "as-is" and the Company disclaims any and all representations and warranties, whether express or implied, including implied warranties of title, merchantability, fitness for a particular purpose or non-infringement. The Company cannot guarantee and does not promise any specific results from use of the Product or any data or information. The Company does not represent or warrant that content or data within the Product is accurate, complete, reliable, current or error-free.
Limitation of Liability
In no event will the Company or its directors, employees or agents be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any lost profits or lost data arising from your use of the Product or any of the data or information from the Product, even if the Company is aware or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, the Company's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to the Company for the service during the term of license, but in no case will the Company's liability to you exceed $1,000.
You acknowledge that if no fees are paid to the Company, you shall be limited to injunctive relief only, unless otherwise permitted by law, and shall not be entitled to damages of any kind from the Company, regardless of the cause of action.
Governing Law, Venue, and Jurisdiction
You agree that the laws of the State of Arizona, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and the Company or any of our affiliates. You agree not to commence or prosecute any action in connection therewith other than in the state and federal courts of Arizona, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of Arizona.
Payment Plan Option
If you choose a payment plan for your subscription purchase, you agree to make all payments in your payment plan. There are no cancellations. There are no refunds.
All Sales Final
Due to the nature of information provided in the Product, all sales are final. There are no refunds.
Notice of Change
Terms, conditions, and pricing are subject to change without notice. Any changes to these Terms of Service will be posted online at www.theweddingreport.com.
